RESUMEN
Este trabajo se propone realizar un enfoque descriptivo y empírico,
así como promover un análisis comparativo sobre el derecho al medio
ambiente en las Constituciones de Brasil, España y África del Sur, con el
como un derecho fundamental y de dimensiones objetiva y subjetiva, en
el contexto de los tres países. La Constitución española, sin embargo, crea
su dimensión subjetiva. Brasil y África del Sur reforzaron el acceso a
la justicia ambiental. La gran divergencia entre los países reside en la
asociada al análisis comparativo de los textos constitucionales de Brasil,
de España y de África del Sur.

CONSTITUTIONALIZATION OF THE ENVIRONMENT IN
BRAZIL, SPAIN AND SOUTH AFRICA: ADVANCES AND
CHALLENGES
ABSTRACT
This search proposes to carry out a descriptive and empirical approach, as
well as to promote a comparative analysis of the right to the environment in
the Brazilian, Spanish and South African Constitutions, in order to present
as a fundamental right and of objective and subjective dimensions, in the
context of the three countries. The Spanish Constitution, however, creates
subjective dimension. Brazil and South Africa have strengthened access
to environmental justice. The great divergence between countries lies in
research will be methodologically based on the bibliographical review
associated with the comparative analysis of the texts of the Constitutions
of Brazil, Spain and South Africa.
