RESUMO
O presente estudo pretende apresentar, de maneira sucinta, o debate em torno de algumas das
interpretações surgidas sobre o capítulo 7 do livro 5 da Ética a Ni cômaco , no qual Aristóteles, que teria
sido o pai intelectual de uma teoria do direito natural, af‌i rma que o direito “político”, a saber, aquele que
rege a vida do cidadão na pólis, é duplo: o direito (to di kaion ) natural, aquele que tem a mesma força
em toda a parte, pois que ele é independente da vontade do legislador, e, de outro lado, o direito legal,
o qual deve sua existência simplesmente ao fato de ter sido positivado.2

ABSTRACT
This study gives a brief overview of the debate around some interpretations of chapter 7 of Book 5 of “Ethica
Nicomachea”, in which Aristotle - considered the intellectual father of “Natural Rights Theory” - aff‌i rms
that Political Rights, i.e. those that govern the lives of citizens in the Polis, is twofold: “Natural Rights” as
those that have the same force everywhere, because they are independent of the legislator’s intention,
and “Legal Rights”, which owe their existence simply to the fact that they have been positivized.
