Abstract
Purpose –
This work intends to map and analyze, through the polycentr ic r egulation
proposa l introduced by Julia Black, the contrib ution of the actors involved in the cr eation
of the data protection regu latory legal r egime in financia l system, after the introd uction of
the cyber security policy by the Ce ntral Bank of Bra zil, the appr oval of the Gener al Data
Pro tection State and new financia l business models.
Methodology –
It first analyses t he regula tory and statutory norms assoc iated with data
protecti on in the financia l system, combined with the cyber security policie s published by
financia l institutions. After this, it identifies the actor s who con tribute to the r egulatory
environment a nd their respective re gulatory r ole. The final ste p is the cr eation of a table
to categorize each actor’s functions in the regulatory regime.
Findings –
The research concludes that the contra cts between fina ncial insti tutions and
technology play a major ro le on crea ting a nd hybr id r egulatory environment for data
protecti on.
Originality –
The work is an original ana lysis of the data protection regu latory legal
regime in financia l system, using polycentric regul ation not only as a theoretica l reference,
but also as a methodologic al framework.
