Resumo
Este artigo tem como objetivo estudar
a regulamentação dada pelos instru-
mentos jurídico-normativos nacionais
e internacionais aos temas correlatos
à bioeconomia, especialmente no que
tange à sua preocupação com a prote-
ção aos direitos humanos. O estudo
foi construído por meio de pesquisa
bibliográca, nos referenciais pertinen-
tes, e documental, nos instrumentos
normativos nacionais e internacionais
aplicáveis à espécie. No que concerne
à escrita, optou-se por utilizar o proce-
dimento dedutivo. O trabalho foi di-
vidido em três partes. Na primeira, fo-
ram tratados conceitos basilares acerca
do conceito de bioeconomia. A seguir,
foram estudados os instrumentos inter-
nacionais relacionados à bioeconomia.
Na sequência, foi estudada a regula-
mentação da bioeconomia no Brasil e
a legislação brasileira em vigor acerca
da matéria. O presente trabalho se jus-
tica, especialmente em decorrência da
necessidade atribuída ao direito de pre-
venir os seres humanos dos potenciais
malefícios da exploração dos recursos
biológicos bem como da necessidade
de regulamentação da bioeconomia, es-
pecicamente, sob o exemplo alemão e
demais instrumentos internacionais re-
lacionados à bioeconomia para preser-
vação e atenção aos direitos humanos.

REGULATION OF BIOECONOMY BY
BRAZILIAN LEGISLATION
is article aimed to study the regulation
given by national and international
legal-normative instruments to themes
related to the bioeconomy, especially
regarding its concern with the protection
of human rights. e study was built
through bibliographic research, in the
relevant references, and documentary, in
the national and international normative
instruments applicable to the species.
With regard to writing, we chose to use
the deductive procedure. e work was
divided into three parts. In the rst, basic
concepts about the concept of bioeconomy
were treated. Next, the international
instruments related to the bioeconomy
were studied. Following, the regulation of
the bioeconomy in Brazil and the current
Brazilian legislation on the subject were
studied. e present work is justied,
especially due to the need attributed to
the right to prevent human beings from
the potential harms of the exploitation
of biological resources as well as the need
to regulate the bioeconomy, specically,
under the German example and other
international instruments related to
the bioeconomy for preservation and
attention to human rights.
