A sessão do Supremo sobre o procedimento do impeachment já começou. Não no Plenário, mas nas páginas dos jornais. O ministro Fachin ainda não apresentou aos colegas suas propostas para uma discussão ampla do rito do impeachment , mas já anunciou sua intenção na imprensa . E há ao menos duas semanas ministros já apresentam publicamente visões sobre o grau de interferência do Supremo no procedimento do impeachment.
Gilmar Mendes, por exemplo, recomendou intervenção mínima para evitar que o Supremo se torne uma "casa de suplicação geral" . "Não considero em princípio tarefa do STF editar normas sobre impeachment" , disse o ministro. Por sua vez, em palestra nos Estados Unidos, Barroso havia observado que o Supremo "não irá interferir, a menos que algo muito ruim ocorra" .
Nestas e outras declarações fragmentadas, a sociedade e os políticos procuram presságios da futura posição colegiada do tribunal. Mas conforme observou recentemente Joaquim Falcão, ministro sozinho não é Supremo . Supremo é o tribunal, que tem em suas mãos o destino do procedimento de impeachment.
Se é assim, por que em vez de trocar declarações pela imprensa, as partes desse tribunal não conversam entre si - antes da sessão de quarta que vem?
Na prática cotidiana do Supremo, em contraste com o que acontece em países como EUA e Alemanha, não há reuniões prévias fechadas entre os ministros para discutir decisões. ministros como Peluso e, na

composição atual, Barroso já apontaram os efeitos da falta desse tipo de reunião no processo decisório cotidiano do tribunal.
Mas em alguns poucos casos decisivos para o país, há uma tradição paralela. E melhor. Em momentos críticos da nossa vida institucional, o tribunal fez reuniões prévias para discussão livre e reservada entre os ministros.
Como revelou Aldir Passarinho em sua entrevista ao projeto História Oral do Supremo, da FGV Direito Rio , os ministros se reuniram de madrugada na véspera da divulgação da morte de Tancredo Neves. Precisavam dar uma resposta sólida à questão da sucessão: o presidente seria Ulysses Guimarães ou José Sarney?
Sydney Sanches, por sua vez, menciona a sessão administrativa fechada que izeram para discutir o procedimento do impeachment de Fernando Collor . Sanches presidiria o julgamento no Senado. Precisava ter certeza de que seguiria um procedimento com apoio inequívoco de seus colegas.
