Abstract
The Brazilian Constitution of 1988 predicts the right to life. However it is not any life that is guaranteed in our Higher Law but the existence
start to be constructed within the family unit. Nowadays, inclusive education has received growing recognition and its importance has been
increasing. In this context, the family of the child with disabilities should be aware of the importance of participating and demanding accessible
citizenship, implying changes in ideas, attitudes, and relationships with individual differences being respected. The methodology used in this
study is based on current legislation – national and international – to show that there is an entire legal apparatus that supports the realization
