ABSTRACT
TThe citizen has the right to culture constitutionally assured (article
215), as well as the duty to protect cultural heritage, once it integrates
the environment (article 225 of the Federal Constitution, 1988). So, this
article has the objective to show the importance of social participation in
the preservation of the cultural heritage, analyzing the principal juridical

the effectiveness of the right to culture and the preservation of the cultural
heritage, besides guaranteeing the intergenerational equity in the access
to culture and the fruition of the environment ecologically balanced.
The use of the juridical instruments, directly or through the provocation
of the legitimate, by society, potentiates the effectiveness of the right to

heritage (inventory, registry, safekeeping and expropriation) mentioned in
the Federal Constitution of 1988 (article 216, 1st §) depend on the direct
