A CONSTITUIÇÃO DE CÁDIS ENTRE A TRADIÇÃO E A MODERNIDADE

RESUMO
Na Espanha, a Constituição de Cádis, de 1812, representou um marco na história do
constitucionalismo moderno, em especial no ibero-americano. Profundamente liberal, trazia
em seu bojo importantes conquistas já positivadas na Constituição Francesa de 1791, como o
princípio da soberania popular e a garantia a direitos individuais, mas diferenciava-se por
tratar igualmente os cidadãos da metrópole e da colônia. Foi promulgada como lei
fundamental e constitutiva da Monarquia católica espanhola e, para tanto, fez uso de três
instrumentos: o juramento, os procedimentos de infrações e a rigidez na reforma. Em
realidade, a quebra da configuração jurídico-política tradicional e sua conseguinte
recomposição significava antes a reconfiguração de elementos da velha ordem tradicional do
que a transição para a modernidade jurídica. Assim, tal qual já o afirmara Alexis de
Tocqueville em relação ao código prussiano, a Constituição gaditana assemelha-se a um ser
monstruoso, dotado de um cabeça moderna sobre um corpo gótico.

ABSTRACT
In Spain, the Cadiz Constitution of 1812 represented a milestone in the history of modern
constitutionalism, especially in Latin American. Deeply liberal, brought in its wake important
achievements already positivated in the French Constitution of 1791, as the principle of
popular sovereignty and the guarantee of individual rights but differentiated from it by
treating equally the citizens of the metropolis and the colony. It was enacted as a fundamental
and constitutive law of the Spanish Catholic monarchy and, therefore, made use of three
instruments: the oath, violations of procedures and rigorousness in reformation. In fact, the
breakdown of traditional legal-political configuration and its therefore recovery meant
reconfiguring traditional elements of the old order than the transition to legal modernity.
Thus, as it was already stated by Alexis de Tocqueville in relation to the Prussian code, the
gaditan Constitution resembles a monstrous being, equipped with a modern head on a gothic
body.

INTRODUÇÃO
Em 2012, comemorou-se os duzentos anos da Constituição de Cádis. De cunho liberal,
ela teve uma enorme repercussão no constitucionalismo ibero-americano e parece passar de
forma desapercebida entre nós, brasileiros, apesar da influência que aqui exerceu: em 21 de
abril de 1821, no Rio de Janeiro, D. João VI jurou a Constituição de Cádis e publicou-a por
