Resumo: Neste artigo defende-se que a teoria constitucional
de Thomas Jefferson é uma teoria republicana cuja ênfase recai
sobre o princípio da soberania popular. Sustenta-se ainda que
as características principais do constitucionalismo jeffersoniano
repousam sobre suas teses a respeito da separação e limitação
dos poderes e a respeito do governo representativo com ampla
participação popular. Nesse sentido, seu modelo dá sustentação
para um constitucionalismo no qual a proteção dos direitos fun-
damentais não se sobrepõe às práticas democráticas e, por con-
seguinte, a Constituição é compreendida como uma estrutura
política, dentro da qual a proteção e realização dos direitos se
inserem, e não apenas como uma estrutura jurídico-normativa
dentro da qual a política opera.

Abstract: This paper defends the position that the constitution-
al theory of Thomas Jefferson is a republican theory whose em-
phasis is on popular sovereignty. It also supports the view that
the main characteristics of Jeffersonian constitutionalism rest on
the thesis of the separation or limitation of powers, and on rep-
resentative government with wide participation of the people.
In this sense, his model provides support for a constitutionalism
in which the protection of fundamental rights does not overlap
democratic practices. Consequently, the constitution is under-
stood as a political framework within which the protection and
accomplishment of rights is inserted. This is not done as a nor-
mative legal framework within which politics operates because,
in this perspective, the protection and realization of rights fall
inside rather than outside politics.
