Resumo
Este ensaio teórico pretende discutir de que modo o direito migratório produz a figura
do “migrante irregular”. A discussão se desenrola a partir do paradoxo migratório
representado pelo di reito de saída de determinado território não acompanhado de um
consequente direito de entrada em outro. Busca-se compreendê-lo em seus e feitos
biopolíticos, que tem como um de seus sintomas a c onstrução do “migrante irregular”
como figura ambivalente: de um lado, sua vida inspira proteção humanitá ria
internacional; de outro, representa um risco em relação ao qual o corpo social deve ser
protegido. Inspirado na genealogia foucaultiana, este e nsaio acadêmico busca atentar-
se para essas estratégias do poder, capaz de nos permitir identificar quando o direito
internacional, sob a pretensão de uma proteção humana universal, atua exatamente na
hierarquização de humanidades.

Abstract
This theoretical essay intends to discuss how migration law produces the subject ivity of
the "irregular migrant". The discussion takes place on the migratory paradox
represented by the right to leave one territory, not ac companied by a consequent right
of entry into an other. It seeks to understand it in its biopolitical effects, which has as
one of its symptoms the con struction of the "irregular migrant" as an ambivalent figure:
on the one hand, his life inspires international humanita rian protection; on the other, it
poses a risk against which the social body must be protected. Inspired by Foucauldian
genealogy, this academic essay aims to draw attention t o these strategies of power in
order to allow us to identify when migration law, under pretension of a universal human
protection, acts exactly in the hierarchy of humanities.
