Resumo: Os tabeliães e oficiais de registro desempenham
uma importante função social, conferindo autenticidade, publicidade,
efetividade e segurança jurídica aos atos jurídicos. A atividade notarial
e registral constitui uma delegação de serviços públicos a particulares,
selecionados por meio de concurso público. Os notários e
registradores são remunerados por emolumentos pagos pelos usuários
do serviço. A natureza dos emolumentos é de tributo, na espécie taxa.
A atividade notarial e registral é regulamentada pela Lei nº 8.935/94.
O direito notarial e registral tem natureza peculiar, mantendo
interatividade com diversos outros ramos do direito. O direito do
consumidor aplica-se à relação exist ente entre o consumidor e o
fornecedor. O Código de Defesa do Consumidor traz em seu bojo
conceitos bastante abrangentes, de forma a englobar o máximo de
relações de consumo possível, prevendo diversos direitos e garantias.
Existe acirrada discussão acerca da ap licabilidade ou não deste
instrumento normativo à atividade registral e notarial. Os defensores
da incidência do código consumerista entendem que a prestação de
serviço pelo tabelião e pelo registrador estaria abrangida pela
conceituação de relação de consumo trazida pelo código, bem como o
referido instrumento legal som ente não seria aplicável quando
houvesse expressa previsão. A corrente de pensamento contrária tem
como argumentos que a atividade notarial e registral possui lei
específica q ue regulamenta a relação com seus usuários, além de a
remuneração do serviço ser realizada por meio de tributo, o que, assim
como a natureza jurídica do serviço, contribuiria para a não incidência
do Código de Defesa do Consumidor. O embate jurídico é de extrema
importância, mas, em que pese haver sólidos argumentos em ambos os
posicionamentos, adota-se o entendimento da não aplicação da
legislação consumerista à atividade registral e notarial. Tal conclusão
decorre da exigência de integridade e de coerência do ordenamento

jurídico e da análise de argumentos adotados pelo STJ para afastar a
lei de proteção do consumidor de outros âmbitos que guardam
similaridades com a atividade de notários e de registradores.

Abstract: Notaries and registrars have an imp ortant social
duty providing authenticity, publicity, effectiveness and legal certainty
to the legal acts. The notarial and registration activity is a public
service delegation to a person that was approved on a public tendering
procedure. Public Notaries and registrars are remunerated with
emoluments payed by the persons that use the services. The legal
nature of the emoluments is tribute, in the specie of tax. The notarial
and registration activity is regulated by Law n. 8.935/94. Notarial and
Registration Law has a peculiar nature, and maintains interactivity
with others branches of law. Consumer Law is applied to the relation
between the supplier and consumer. The Consumer Protection Code
brings very comprehensive concepts with the intention of encompass
the maximum of consumer relations as possible, listing lots of rights
and guarantees. There is a h eated discussion about the application or
not of this normative instrument to the notarial and registration
activity. The defenders of the incidence of the consumer code consider
that the service provided by the notary and the register is embraced on
the concept of consumer relation announced by the code and also the
legal instrument would not be applied when it has express provision.
The contrary current of thought argue that the notarial and registration
activity is ruled by a specific law that regulates the relation with its
users and also the legal nature of the service contributed to the n on-
incidence of the Consumer Protection Code. This legal discussion has
a major importance, which despite the existence of substancial
arguments in both sides, the conclusion of this study is that the
Consumer Protection C ode does not apply to the notarial and
registration activity. It reaches such conclusion after considering the
demands for integrity and coherence of th e juridical order and the
arguments underlying Superior Court of Justice´s rulings in Brazil that
did not apply the Consumer Protection Code to other realms of life
that have similarities with notaries and registrars´activities.

Os notários e registradores são profissionais dotados de fé pública que
exercem uma função de notória importância, formalizando atos e negócios jurídicos,
garantindo efetividade, autenticidade e segurança jurídica, de forma célere e eficaz.
Tabeliães e oficiais de registro estão em constante contato com a sociedade,
sendo necessário analisar a natureza dessa atividade e quais normas irão
regulamentar essa relação e ntre esses profissionais e os usuários do serviço
extrajudicial.
