A experimentação animal na nova Lei 11.794/08 à luz da interpretação conforme a Constituição

RProcurasedemonstrarnotextoqueapercepçãoexpandida
do círculo de sujeitos morais repercute com relevância na esfera
jurídica das democracias modernas. Nessa esfera, a supremacia das
ConstituiçõesNacionaiséarmadanãosónoprocessolegislativocomo
também, e especialmente, na hermenêutica e aplicação constitucionais,
que levam em consideração e dão prioridade à otimização de princípios
e garantias eticamente mais importantes do texto. Defendemos, no
trabalho, que, no Brasil e em referência aos animais não-humanos,
uma boa interpretação signica entender os mesmos como sujeitos
individuais de direitos, ou seja, com valor inerente e, portanto, direito
fundamental ao respeito, mesmo que não sejam agentes morais livres.
Uma das consequências é não cometer contra eles nenhum tipo de
crueldade, conforme prescrito na Constituição Federal. Para tanto,
todas as leis infraconstitucionais devem ser avaliadas e aplicadas
nesse sentido, ou seja, sob o método da conformidade teleológica com
a norma extraída da Constituição Federal. Isso, no caso da nova lei
reguladora da experimentação animal, a Lei Federal 11.794/08, mais
conhecida como Lei Arouca, em virtude do nome de seu primeiro
propositorsignica interpretálarestritivamente ouseja aplicando
dela apenas o que não contrariar o princípio constitucional da não-
crueldade, o qual tem seu teor esclarecido pela Lei 9.605/98, a Lei de
Crimes Ambientais. Tal critério interpretativo é imperativo porque a
Lei Arouca é uma lei que traz, em si, muitas autorizações acerca do

uso de animais não-humanos em atividades didáticas e de pesquisa
no âmbito dos estabelecimentos de ensino brasileiros e, sendo
interpretada sem uma metodologia prudente, pode retroceder em
diversos avanços normativos já ocorridos no Brasil.

A It seeks to demonstrate in the text that the expanded
awareness of the circle of moral subjects relevantly echoes in the
legal sphere of modern democracies. In this sphere, the supremacy of
NationalConstitutionsis armednotonly inthelegislativeprocess
but also, and especially, at the constitutional hermeneutics and
application, which takes into account and give priority to principles
and warranties’ optimization that are ethically more important in the
text. In this work we advocate that, in Brazil and in reference to non-
human animals, a good interpretation means to understand them as
individual subjects of rights, in other words, with inherent value and,
therefore, fundamental right to respect, even if not free moral agents.
One of the consequences is not to perpetrate any kind of cruelty
against them, such as prescribed by the Federal Constitution. To this
end, all infraconstitutional laws must be evaluated and implemented
in this direction, in other words, under the teleological method of
compliance with the rule drawn from the Federal Constitution. That,
in the case of the new law that regulates animal testing, the 11.794/08
FederalLawmoreknownasAroucaLawduetothenameofitsrst
proposer, means to read it restrictively, in other words, applying from
it only what does not contradicts the non-cruelty principle, which has
itscontent clariedby the Lawthe EnvironmentalCrimes
Law. This interpretation standard is imperative because the Arouca
Law is a law that brings in itself many commitments on the use of non-
human animals in research and teaching activities within the Brazilian
schools and, then, if taken without a prudent approach, it can recede
the various normative advances that have occurred in Brazil.
