  • The unbundled union: politics without collective bargaining

    Public policy in the United States is disproportionately responsive to the wealthy, and the traditional response to this problem, campaign finance regulation, has failed. As students of politics have long recognized, however, political influence flows not only from wealth but also from organization, a form of political power open to all income groups. Accordingly, as this Essay argues, a promising alternative to campaign finance regulations is legal interventions designed to facilitate political organizing by the poor and middle class. To date, the most important legal intervention of this kind has been labor law, and the labor union has been the central vehicle for this type of organizing. But the labor union as a political-organizational vehicle suffers a fundamental flaw: unions bundle political organization with collective bargaining, a highly contested form of economic organization. As a result, opposition to collective bargaining impedes unions’ ability to serve as a political-organizing vehicle for lowerand middle-income groups. This Essay proposes that labor law unbundle the union, allowing employees to organize politically through the union form without also organizing economically for collective bargaining purposes. Doing so would have the immediate effect of liberating political-organizational efforts from the constraints of collective bargaining, an outcome that could mitigate representational inequality. The Essay identifies the legal reforms that would be necessary to enable such unbundled “political unions” to succeed. It concludes by looking beyond the union context and suggesting a broader regime of reforms aimed at facilitating political organizing by those income groups for whom representational inequality is now a problem.

  • La incidencia del TLC con EE. UU. en la normatividad de las cooperativas de trabajo asociado en Colombia

    Colombia, debido a la necesidad de contar con un tratado de libre comercio con Estados Unidos, realizó de manera paulatina algunas reformas a su legislación laboral, con miras a lograr la ratificación del TLC por parte del Congreso de este país. Dentro de dichas reformas, uno de los asuntos que más trabajó el Estado colombiano fue lo relacionado con las Cooperativas de Trabajo Asociado (CTA), las cuales en la práctica venían utilizándose indebidamente para permitir la contratación indirecta de trabajadores y ocultar al verdadero empleador, por lo cual, las reformas se encaminaron a limitar su marco de acción, sancionar a quienes incurrieran en estas conductas y promover la formalización laboral a través de la condonación de multas a cambio de una contratación directa del trabajador, sin que esto por sí solo haya logrado una solución de fondo al problema de la subcontratación viciosa para hacer fraude al contrato de trabajo y a las garantías de los trabajadores.

    Working time is subject of health and safety in the form of the Working Time Act (ArbZG) as well as of works councils’ co-determination under section 87 (II) Nrs. 2 and 3 Works Constitution Act (BetrVG), (at times) section 99 Betr- VG and of individual and colletive contractual arrangements. Under health and safety aspects, it is about limitation of working time to a maximum permissible threshold and its interruption through necessary repose periods in order to avoid health endangering impacts on the employees. The paper describes the baselines of the German Working Time Act’s rules and the limits to flexibility possible according to it, which are to be tested constantly for their conformity with EU law in the (Working Time) directive 2003/88/EC of 4 November 2003. The question which activities constitute “work” under the German and European rules is of particular importance. There is no definitive answer to this question yet for diverse employee duties and activities for the benefit of others. For co-determination under section 87 (II) Nr. 2 BetrVG the question is, on which weekdays and which concrete times of day employees shall work, i.e. when exactly does working time start and end? In this context as well, it is of importance which activities are “work”, e. g. whether putting on protective clothing at the work place counts as work. For co-determination under section 87 (I) Nr. 3 an alteration of the usual working time volume may only be “temporary”, for co-determination under section 99 BetrVG the increase of the hitherto existing volume must be “significant”. The paper describes the problems in detail. It must be resolved in individual contracts to which temporal extent the employee owes work at all. Here, section 307 Civil Code (BGB) requests sufficient clarity, in particular regarding the agreement for which temporal work extent the employer owes which reimbursement. Here as well it has to be determined what belongs to reimbursable “working time”. This is not necessarily coinciding with the health and safety or the co-determination realm.

    Este estudo faz uma análise crítica da regência jurídica celetista conferida aos danos extrapatrimoniais, com ênfase naquilo que não está expressamente consignado na lei. Abordam-se a não taxatividade dos direitos extrapatrimoniais dos trabalhadores suscetíveis de violação e reparação, a possibilidade de reparações não pecuniárias do dano extrapatrimonial trabalhista, a permanência da plena reparabilidade dos danos morais coletivos ocorridos na esfera trabalhista, a teoria do piso implícito conducente a valores mínimos de reparação do dano extrapatrimonial, a possibilidade de diálogo com o Código Penal para definição dos graus de gravidade do dano extrapatrimonial em matéria de acidente do trabalho e a necessidade da regra de tarifação prévia do valor reparatório de danos extrapatrimoniais prestar obediência aos ditames constitucionais. O texto intenta descortinar caminhos hermenêuticos no marco dos direitos fundamentais.

  • Tre note sui 'precedenti' nella evoluzione della giurisprudenza della corte costituzionale, nella giurisprudenza di una corte di cassazione necessariamente ristrutturata e nella interpretazione delle norme processual

    Lo scritto esamina tre dimensioni del precedente giurisprudenziale. La prima riguarda l’evoluzione della giurisprudenza dela Corte costituzionale dalle sentenze interpretative di rigetto a quelle interpretative di accoglimento, fino alle attuali sentenze di inammissibilità alla presenza della possibilità di interpretazioni costituzionalmente orientate. La seconda riguarda la necessità di riforme strutturali della Corte di cassazione, al fine di consentirle l’emanazione di precedenti persuasivi. La terza concerne la specificità dell’interpretazione di norme processuali e dei problemi posti dai relativi mutamenti repentini di giurisprudenza.
