RESUMO
O presente artigo consiste em analisar um dos mais importantes instrumentos jurídicos
do direito constitucional contemporâneo, instituído e apontado por alguns teóricos como
um dos principais avanços da Reforma do Poder Judiciário (EC nº 45/2004), a saber,
a súmula vinculante editada pelo Supremo Tribunal Federal. Para isto, objetiva-se
propor uma nova reflexão sobre a incidência da Súmula Vinculante correlacionando a
Teoria do Poder de Violência Simbólica, tendo em vista que o escopo do supracitado
instituto jurídico constitucional é preservar a coerência e harmonia com o sistema jurídico
e social, e ao mesmo tempo, (re)estabelecer o controle das inúmeras interpretações
jurídicas existentes e ditas controversas no campo jurídico e extrajurídico das relações
intersubjetivas da sociedade. Consolidando, deste modo, o entendimento jurídico
do Supremo Tribunal Federal sobre determinada matéria em conflito interpretativo,
repercutindo por final segurança jurídica ao ordenamento jurídico brasileiro.

ABSTRACT
This article is to examine one of the most important legal instruments of contemporary
constitutional law established and appointed by some theorists as a major advancement
of the Reform of the Judiciary (EC no. 45/2004), namely binding precedent issued by
the Supreme Court. For this, we aim to propose a new reflection about the incidence
of binding precedent, correlating the Theory of Power Simbolic Violence, conside ring
that the scope of the Supreme Court is to preserve the coherence and harmony with the
legal and social system and at the same time (re) establish the control of the numerous
legal and controversial interpretations that exist in the legal and extralegal fields of
intersubjective relations of society. Consolidating, thus, the legal opinion of the Supreme
Court about a particular subject during its interpretive conflict, reflecting a legal end to
the Brazilian legal system.
