Resumo: O presente estudo sob o tema O retrocesso dos Direitos Sucessórios dos Conviventes no
Código Civil atual e uma nova proposta Politico Jurídica tem por pressuposto a Linha de Pesquisa
Regulação da )nfraestrutura e juridicidade da Avaliação Estrat égica dentro da Área de Co ncentração
das Ciências Socia is Aplicadas. Após o reconhecimento da União Estável como entidad e familiar na
Constituição Federal de 1988 foram editadas leis esparsas com o objetivo de regulamentar os direitos
dos conviventes, dentro os quais os Direitos Sucessórios. A pesquisa direciona-se à demonstra r a
ocorrência de um retroc esso na proteção específica dos Direitos Sucessórios decorrentes da União
Estável com o advento do Código Civil atual. Tem por objetivo geral empreender uma abordagem
acerca do retrocesso ocorrido nos Direitos Suc essórios dos Conviventes e a partir da Politica Jurídica,
Comporta como objetivos específicos, a verificação do retrocesso ocorrido, bem como a averiguação da
possibilidade de propor uma alteração legislativa com base na Política Jurídica, a fim de ga rantir uma
proteção efetiva à União Estável. A metodologia a ser utilizada no desenvolvimento da pesquisa
compreende o método cartesiano quanto à coleta de dados e no relatório final o método indutivo com
as técnicas do referente, da categoria, dos conceitos operacionais, da pesquisa bibliográfica e do
fichamento.

Abstract: This study under the theme "The recession of the Succession of cohabiting Rights in the
current Civil Code and a new proposal Legal Politico" is the assumption Research Line "Regulation of
Infrastructure and legality of Strat egic Assessment", within the Area of Concentration of Applied Social
Sciences. After recognition of Domestic Part nership as a family unit in the Federal Constitution of 1988
sparse laws were enacted for the purpose of regulating the rights of cohabiting within which the Rights
Succession. The survey directs to the show the occurrence of a setback i n the specific protection of
Succession Rights a rising from the Stable Union with the advent of the current Civil Code. Has the
objective to undertake an approach on setback occurred in Succession Rights of cohabiting and from
the Legal Policy, propos e a legislative change to the current regulation of these rights in the current
Civil Code. Behaves as specific objectives, verification kic k occurred, as well as to investigate the
possibility of proposing a legislative amendment on the basis of Legal Policy in order to ensure
effective protection of Stable Union. The methodology to be used in the research comprises the
Cartesian method to the collection of data and the final report the inductive method with the
techniques of the referent category, operational concepts, the literature and the BOOK REPORT.
